I4i has won the support of the U.S. government as its patent infringement case against Microsoft winds it way to the U.S. Supreme Court.(Credit:Daniel Terdiman/CNET)The case stems from a lawsuit filed by I4i in 2007 in which it claimed that Microsoft had violated one of I4i's patents by including a custom XML feature in Microsoft Word. Though Microsoft lost on both the initial verdict and the appeal, the software giant filed another appeal last year, this time with the Supreme Court, which agreed last November to hear the case.I4i, a small Canadian company, has received strong support in the form of 22 different amicus briefs filed with the Supreme Court, the latest coming from the U.S. government itself, specifically from the U.S. Solicitor General (PDF). These briefs urge the court to uphold the decisions of the lower courts in favor of I4i. Joining the U.S. government in support of I4i are a range of parties, including corporations, universities, venture capitalists, and former U.S. Patent Office commissioners."The amicus briefs underscore the importance of the case and the extremely damaging consequences if the law is changed and there is a ruling to overturn the lower court's correct decision in favor of new law changes which Microsoft proposes," said I4i Chairman Loudon Owen in a statement. On its end, Microsoft sees its appeal to the highest court in the land as part of an overall effort to change the way that patents are legislated. Backing Microsoft's appeal are a slew of other tech giants, including Apple, Intel, Google, Yahoo, Facebook, and Hewlett-Packard.The Supreme Court will start to hear the case on April 18 with a decision expected by the end of June.

0 Vote(s)

CANCUN, Mexico--Mexico is pushing parties at the United Nations climate change meeting to strive for the best possible deal, although even the most ambitious agreement will fall short of what is needed to deal with climate change. Acknowledging that thorny issues such as agreeing to a second round of greenhouse gas emissions cuts under the Kyoto Protocol are unlikely to be resolved at the talks at the beach resort of Cancun, Mexico's top climate change diplomat told reporters that he feels a major step forward could be made. "The big challenge is not to just capture in a United Nations document the commitments and actions of developed and developing countries, but to find a way on one hand to increase these...and find a mechanism to keep going," said Luis Alfonso de Alba at a news conference. Progress on a new global climate change agreement has been slow as developed countries complain that the United Nations' 1992 climate convention is outdated, focusing too much on them when China's rapid economic growth has made it the world's top carbon emitter. Most countries agreed on a formula at last year's Copenhagen summit whereby industrialized countries would cut their emissions while emerging economies took "climate actions" to slow growth in greenhouse gases. Objections by some nations prevented it, however, from being formally adopted by the U.N. "Kyoto covered at most 28 percent of global emissions and had goals that barely surpassed 5 percent of global emissions," de Alba said. "In Cancun we are hoping to come out with a package of emissions reductions that will certainly, if what countries have announced is made concrete, will surpass 18 or 19 percent on a global level."Deal needed The cuts envisioned by parties at Cancun fall short of what scientists say is needed to limit the rise in average global temperatures to less than 2 degrees Celsius, de Alba said, but a deal would breath new life into the multilateral process. The Cancun meeting has seen so far little of the rancor and inflexibility that marked the Copenhagen summit as negotiators appear to have accepted that an incremental approach is the best that can be hoped for at this time. The most controversy has come from Japan's claim that extending the Kyoto protocol is "meaningless" without a broader pact that includes China and the United States, the world's top two emitters of greenhouse gases. The stance of Japan, and some other countries including Canada and Russia over Kyoto, has prompted accusations by environmental groups and some developing countries that rich nations are trying to shirk their commitments. "Everyone is for the continuity of Kyoto, but in some manner this is linked to complementary or additional efforts. What we have to be aware of is that we have a brief period to take decisions but this period ends in 2012, not the end of Cancun," de Alba said.Story Copyright (c) 2010 Reuters Limited.
Vzaar, an online video platform aimed at SMEs that want to publish video, has been plugging away since 2007, but seemed to go in an odd direction &8211' aiming at eBay sellers who wanted to sex-up their auctions. Needless to say it was the low end of the market and eBay auctioneers tend not want to spend money on a dedicated video platform outside of free ones like YouTube. But after bringing in new management, new CEO Stephen McCluskey, formerly with PA consulting group, has pivoted the company towards a more upstream market and gone out looking for new funding. Through various twists and turns on that funding road it&'s now found further funding &8211' terms undisclosed &8211' through a slightly left-field source, namely Hollywood director Oliver Stone, famous for movies on The Doors, JFK and Wall Street. He&'s invested alongside existing investor Sophrosyne Ventures LLP.The investment came about through Stone&'s longstanding relationship with John Moreton, one of vzaar&'s major investors. Normally that&'s where the story peters out, but Stone has gone one further than most investors &8211' filming an actual commercial for the company when he was in London attending the premiere of &8216'Wall Street 2: Money Never Sleeps&'Apparently, Stone&'s rational was that even though there is a rivarly between online video and cinema, he is interested in the issues around wider content distribution.Vzaar natural competitors are now Kyte, Kaltura, Viddler, LongTailVideo and new arrival 23 Video, but, I&'m told Vzaar&'s sales are up in their new $50 up to $1500 offering. It now has 1,200 customers worldwide.Just don&'t mention &''greed is good&'' or even &''I liked it so much, I bought the company&''.
While only 4 percent of US online adults have ever used a location-based service, like popular check in app Foursquare, data from research firm Forrester shows that young adult males with college degrees appear to be the main user group. In addition to being the main user group, the group may also be heavy online influencers as 38% of them claim that their networks ask them for their opinion before making a purchase decision. It would be interesting to know what types of products their networks ask them about before a purchase. Most likely, it&'s probably electronics. Finally, the data shows that the group may also be heavy mobile researchers, meaning that they are more likely to search for information on products or services as well as look up ratings and reviews. If the user group is constantly checking in to locations, then they are probably also using their smartphones for the following. The nifty graph below spotlights more specifics location-based service users to US online adult users.Next Story: Can we just agree that the iPad 2 will have cameras already Previous Story: VCs level up with &''gamification&'' investmentsPrintEmailTwitterFacebookGoogle BuzzLinkedIn DiggStumbleUponRedditDeliciousGoogleMore&8230' Tags: demographics, LBS, location based services, location-basedCompanies: Forrester, Foursquare Tags: demographics, LBS, location based services, location-basedCompanies: Forrester, FoursquareCody Barbierri is a social and digital media consultant.
Here&'s the latest action we&'re following today on the GreenBeat:Tesla posts losses for fourth quarter &8212' Electric car company Tesla released its fourth-quarter and 2010 earnings yesterday and said it would be looking to raise another $150 million to develop its all-electric SUV concept the Model X. The company posted $51.4 million in losses last quarter, up from $24.2 million in the fourth quarter of 2009. Revenues increased from $36.3 million for the fourth quarter, up 30 percent from the previous quarter and up from the $18.6 million in revenue posted the fourth quarter of 2009. Revenues for the full year of 2010 totaled $116.7 million compared to $111.9 million prior year. Tesla said it expects to increase revenues this year by 40 to 50 percent, reaching $160 million to $175 million in 2011. (The company&'s all-electric sedan, the 2012 Model S, is pictured.)Tessera sells solar project to AES &8212' Troubled solar company Tessera said today it had sold the second of its major projects, the 709-megawatt Imperial Valley Solar project in California. The project was bought by AES Solar, a joint venture between the AES Corporation and Riverstone Holdings. Tessera sold its Calico solar project in California to power developer K Road last year, after Tessera was reported to be in trouble. Last year, a judge granted an injunction barring construction on the Imperial Valley project after a Native American group filed a suit against it.Schneider Electric launches residential electric car charger &8212' The building energy management gurus have been moving more and more into home energy offerings lately. The company announced today an electric car charging solution for homes that includes a delayed charging option and an LED display. A company statement cited a Pike Research report that estimates one million electric cars will be sold annually around the world by 2012, and three million electric cars will be in use that year.OPX Biotechnologies to commercialize renewable acrylic &8212' We wrote last week about how the future of biofuels companies now increasingly includes the making of renewable chemicals and other materials. Venture-backed OPX Biotechnologies announced today that it has hit performance and cost goals for its BioAcrylic product after 18 months of pilot-scale development. The company says its acrylic can be produced at a lower cost than traditional acrylic, which is derived from petroleum.Next Story: McAfee aims to protect connected gadgets Previous Story: Sonya4a4s S1 PlayStation tablet wona4a4t look like any otherPrintEmailTwitterFacebookGoogle BuzzLinkedIn DiggStumbleUponRedditDeliciousGoogleMore&8230' Tags: biochemicals, biofuels, biomaterials, electric car charing, electric cars, Model X, SolarCompanies: AES, AES Solar, Opx Biotechnologies, Riverstone Holdings, Schneider Electric, Tesla, Tessera Solar Tags: biochemicals, biofuels, biomaterials, electric car charing, electric cars, Model X, SolarCompanies: AES, AES Solar, Opx Biotechnologies, Riverstone Holdings, Schneider Electric, Tesla, Tessera SolarIris Kuo is the VentureBeat's lead GreenBeat writer.
Here&'s a great example of how a seemingly noble social media donation campaign can go awry: Microsoft tweeted two hours ago on the Bing search engine&'s Twitter account that it would donate up to $100,000 to help victims of Japan&'s earthquake &8212' but only if Twitter users retweeted its original post to broadcast it to their followers, at $1 per retweet. While many Twitter users are retweeting without complaint, others are pointing out that this campaign seems like a crass marketing opportunity for Bing.Comedian Michael Ian Black, who has nearly 1.6 million Twitter followers, graphically responded to the campaign with this tweet: &''Hey @bing, stop using a tragedy as a fucking marketing opportunity.&'' Searching for &''@Bing&'' on Twitter at the time of this post reveals plenty of other users who aren&'t taking too kindly to Microsoft&'s campaign. This backlash shows us that as useful as social media is for inspiring activism, it must be carefully deployed so as not to seem like a craven publicity stunt. Most recently, we saw a similar backlash to Kenneth Cole&'s tweet about Cairo amid Egypt&'s recent protests, in which the fashion label plugged its spring collection.I can&'t imagine how Microsoft didn&'t see this coming. It would have received plenty of good will by simply donating $100,000 to help out quake victims. This campaign, on the other hand, seems like a forced attempt to get people talking about Bing, and ultimately to get it trending on Twitter. Now people are indeed talking about Bing, but Microsoft likely won&'t appreciate what they&'re saying.Update: the Bing folks have now apologized and will donate the full $100,000 amount to help the quake victims.Tweet image via Ethan MaffeyNext Story: Week in review: Epic Games shows off amazing graphics Previous Story: Entrepreneur Corner: Separation agreements and product development advancesPrintEmailTwitterFacebookGoogle BuzzLinkedIn DiggStumbleUponRedditDeliciousGoogleMore&8230' Tags: Bing, donations, fail, Japan, Japan quake, search engines, tweetsCompanies: Microsoft, Twitter Tags: Bing, donations, fail, Japan, Japan quake, search engines, tweetsCompanies: Microsoft, TwitterDevindra Hardawar is VentureBeat's lead mobile writer and East Coast correspondent.
