Microsoft, HTC, Nokia, and Sony Ericsson have filed formal applications for a declaration of invalidity against Apple's trademarks for "App Store" and "Appstore" with the Community Trade Mark office in Europe. The four companies join Amazon, which filed a similar complaint in Europe against Apple in mid-April. All seek to get Apple's two European trademarks invalidated, saying the moniker is too generic."Today's filings by HTC, Nokia, Sony Ericsson, and Microsoft, like Amazon's recent action, demonstrate the breadth of opposition to Apple's unsupportable claim of exclusivity," a Microsoft representative said in a statement. "'App store,' like 'toy store' or 'book store,' is a generic term that should continue to be available for everyone to use for stores that sell apps."The new claims specifically call out Apple CEO Steve Jobs for referring to competing applications markets on another phone platform--specifically Google's Android--as "App Stores." The claims also highlight the fact that several other retailers make use of the term, including Shopify, Sendmail, and DirectTV.Apple did not immediately respond to a request for comment. This move follows a similar legal effort in the U.S. by Microsoft in January. Apple's attempts to trademark the term "App Store" with the U.S. Patent and Trademark Office back in 2008 resulted in Microsoft launching a legal battle, complete with both sides obtaining linguists, and other language experts to argue whether the two words were synonymous with Apple's App Store, or mobile application stores in general. Why are these companies so worried For one thing, Apple's already gotten litigious on the matter. Back in March, Apple sued Amazon over its use of the "Appstore" in the title of its mobile application store for Android devices. At the time, an Apple representative said Amazon's word choice could "confuse and mislead customers." Amazon responded by countersuing, and followed a similar party line to Microsoft, saying Apple's claims were too generic.Updated at 10:15 p.m. to clarify that Apple already has the trademarks for "Appstore" and "App Store" in Europe.

0 Vote(s)

A Gen7 School at Bolsa Knolls Middle School in Salinas, Calif.(Credit:American Modular Systems)Could prefab structures be a quick and cost-saving way to get U.S. students out of dilapidated and energy-sucking schoolsA recent award to a Gen7 school building, made by American Modular Systems, seems to signal that modular classrooms have moved beyond being ad hoc building solutions for developing nations. For the first time in California, a prefab building has been awarded national Collaborative for High Performance Schools (CHPS) certification for new school construction. CHPS certification is awarded to those schools that meet specific health, comfort, maintenance, and environmental sustainability standards."The Gen7 classroom proves that a prefab structure can achieve the same desired high performance results as a conventional building," CHPS Executive Director Bill Orr said in a statement. The Bolsa Knolls Middle School in Salinas, Calif., which has added a Gen7 school building that will house classrooms, met the CHPS requirements. The building will hold six classrooms totaling 5,760 square feet, and it reportedly will exceed the California Title 24 Energy Code by more than 30 percent. The permanent structure was designed and built in about 60 days, according to Gen 7.Features of the building include: smart lighting, Energy Star-rated tubular skylights, thermal ventilation, and interiors made from low- and no-VOC (volatile organic compounds) materials. The building is 100 percent recyclable, and made almost entirely of recycled materials.Whether the idea takes off across the nation remains to be seen, but some California school districts, at least, seem to be interested. In addition to Bolsa Knolls, the Santa Rita Union School District has ordered eight Gen7 classrooms and a restroom facility slated for installation in June 2011, according to American Modular Systems.

0 Vote(s)

The U.S. Department of Argiculture today awarded $405 million in loan guarantees for biofuel refineries. All three recipients, Coskata, Enerkem and Ineos Bio, make biofuels by using waste as a feedstock, which is considered an advantage in the crowded biofuels market. It&'s also a sign of good news for the industry, where biofuels makers have struggled to bring technologies to commercial scale production. The Department of Energy&'s loan chief hinted to us last year that the government would be looking to invest more in biofuels, since loan guarantee programs aim to help promising companies get to commercial scale production of renewable energies. The government sets mandates for how much ethanol must be blended with petroleum each year in order to meet national renewable fuels standards. The mandates essentially guarantee biofuels makers a market' however, producers haven&'t been able to meet the high goals &8212' in part because financial markets collapsed in 2008, Coskata executive Wes Bolson told me last year. (Pictured is the company&'s semi-commercial facility in Pennsylvania). The loan guarantees announced today went to:Coskata &8211' The company received the largest biofuels plant loan guarantee ever, $250 million for a cellulosic ethanol facility in Green County, Ala. with an annual capacity of 55 million gallons per year. Coskata is backed by Khosla Ventures, Blackstone Group and GM, among others. It uses woody biomass as feedstock.Enerkem &8211' Enerkem earned an $80 million loan guarantee for a 10 million gallon-per-year plant in Pontotoc, Miss. thatwill use municipal solid waste as a feedstock to turn into biofuels. The company also received a $50 million award from the Department of Energy for the same plant in 2009. The Montreal-based companybroke ground last year on a Canada plant with a capacity of 10 million gallons per year. Enerkem&'s investors include Rho Ventures, Braemar Ventures and Waste Management.Ineos Bio &8212' The company received a $75 million loan guarantee for a biorefinery in Vero Beach, Fla. capable of producing 8 million gallons per year of cellulosic ethanol, using vegetative waste like citrus, agricultural, yard, wood and municipal solid waste. Ineos is a spinoff from a its parent company, chemicals player Ineos.Next Story: Meet Google&'s new CEO, same as the old CEO: Larry Page Previous Story: Will tweets make Techmeme even more addictive for tech news junkiesPrintEmailTwitterFacebookGoogle BuzzLinkedIn DiggStumbleUponRedditDeliciousGoogleMore&8230' Tags: biofuels, cellulosic ethanol, ethanolCompanies: Coskata, DOE, Enerkem, Ineos, Ineos Bio, USDAPeople: Wes Bolson Tags: biofuels, cellulosic ethanol, ethanolCompanies: Coskata, DOE, Enerkem, Ineos, Ineos Bio, USDAPeople: Wes BolsonIris Kuo is the VentureBeat's lead GreenBeat writer.
