<description><![CDATA[The Federal Communications Commission is a step closer to approving the $37 billion joint venture between Comcast and General Electric's NBC Universal. FCC Chairman Julius Genachowski gave his blessing today to the new joint venture, which was announced a year ago. He circulated an order among the four other FCC commissioners stating that he believes the venture, which will be controlled by cable giant Comcast, will be in the public interest, paving the way for the full FCC to approve the marriage between the two companies. That full FCC approval isn't expected until January. The deal must also be approved by the Department of Justice, which is still examining the deal. Genachowski noted that he only approves of the deal if Comcast and General Electric, which owns NBC Universal, can agree on certain conditions. These conditions are meant to protect consumers from Comcast asserting too much control over content and distribution services. Once the deal is completed, Comcast will own 51 percent of the new joint venture.There is particular concern that Comcast, loaded with NBC Universal content, will have too much power in determining how the Internet develops as a video medium. Consumer groups and other critics fear that Comcast will stifle this emerging medium. They are also fearful that Comcast will use its strong content position, with cable channels, such as MSNBC, USA, and Bravo, to harm its existing paid TV competitors.Earlier this week, the FCC pushed through controversial rules meant to prevent the owners of high-speed lines and airwaves, such as Comcast, from favoring their services and content over competitors' content and services. The FCC chairman's office has not released details of the proposed conditions it hopes to put on the deal, but during a call with journalists today, representatives gave a sense of areas that the agency is examining. First, the agency is looking at ways to ensure that Comcast will not be able to favor its own video content over content of its rivals. For example, the conditions would likely make it difficult for Comcast to withhold content from its paid TV competitors. And it will not be able to slow or block traffic from online video providers such as Netflix.The FCC is also examining the role that Comcast should play in Hulu, the online video service that is partly owned by NBC Universal. Walt Disney Co. and News Corp. are also co-owners of Hulu. Comcast has its own online video site and some opponents of the merger are worried that Comcast may cripple the service in some way, because it is seen as a competitor to its existing cable service or its online video services.Eventual approval of the merger could require Comcast to share its NBC programming with online video providers, who have reached similar deals with Hulu partners and competitors Walt Disney and News Corp.The agency is also considering measures that would put conditions on where Comcast can place the NBC channels on its cable TV lineup. In addition, it is likely to require Comcast to keep similar channels, such as sports or news channels, close to its rivals' similar channels. Any conditions that the FCC puts on Comcast could eventually expire or be reviewed on a regular basis to see if the government still thinks they are necessary.Genachowski's recommendation must be approved by the other four FCC commissioners, who could change aspects of the conditions. The two Republicans on the FCC are likely to want fewer conditions, while the two Democrats are likely to ask for more conditions, or at the very least stricter conditions.Regulators have spent roughly nine months reviewing the deal antitrust issues and to ascertain whether the deal is in the public interest. Comcast executives had expected regulators to conclude their review and approve the deal by the end of the year. <description><![CDATA[The long saga of the Lime Wire company appears to be close to an ending.The maker of the popular LimeWire file-sharing software--a peer-to-peer setup along the lines of the original Napster--has announced that at the beginning of next year, it will cease business, as originally reported by Peter Kafka at All Things Digital.Owing to a copyright complaint filed against it in 2006 by the Recording Industry Association of America, Lime Wire had already been ordered, in October of this year, to shut down its P2P service. But, following Napster's example, it had previously opened a legitimate online music subscription service, featuring content from independent labels, and had said it was planning to set up a new service that would include content from the majors. It seems those efforts are both going the way of the P2P program.&quot;Given our current situation, plans to bring our separate, legal music service to market have been canceled. The beginning of 2011 will mark the closing of LimeWire's New York office and cessation of business by LimeWire,&quot; Kafka quoted the company as saying. The LimeWire Store also bears a notice informing visitors that no new subscribers are being accepted and that existing subscriptions will not be renewed.Kafka speculated that the company was trying to trim its assets prior to a court decision on how much it owes the major music labels as a result of the ruling in the RIAA case.That ruling found that Lime Group, parent of Lime Wire, and founder Mark Gorton committed copyright infringement, induced copyright infringement, and engaged in unfair competition. Likely to be marked as v2.3, Gingerbread is said to focus more on aesthetics as opposed to additional features. Other details include WebM support, better copy and paste functionality, and improved social-networking features.Reading the tea leaves, it certainly appears that an SDK announcement is around the corner. A giant gingerbread man statue was dropped off at Google headquarters two weeks ago, where he now stands next to previous delicious builds of Android, including Froyo (2.1) and Eclair (2.0). Typically, Google announces an SDK or a phone within a few weeks of new lawn ornaments. Samsung was recently tied to &quot;Nexus Two&quot; rumors where it will reportedly debut the 2.3 build. A few Android blogs have also spotted Android 2.3 and 3.0 (Honeycomb) in their recent traffic analytics reports, leading many to believe testing is being actively conducted.The latest release of Google Maps might be our first glimpse into how applications and menus will look. A clever Freenode IRC member, canadiancow, noticed that the app came with a folder hiding new graphics and interface tweaks. Look for a crisper, sharpened appearance to the overall user experience with a hint of green.Verizon has a couple of devices expected to launch November 11, but I don't expect to see Gingerbread loaded on them just yet. <description><![CDATA[(Credit:Skyfire)Flash is still banished from Apple'siPhone, but amobile browser is opening the door--at least partially--to the technology.After its recent approval by Apple, Skyfire, a mobile Web browser that converts Flash videos to HTML5, hit the App Store today at 2 p.m. PT.Selling for $2.99, the app has been awaiting Apple's thumbs-up since it was submitted for approval more than two months ago.Skyfire uses a trick to coax Flash videos to run on the iPhone andiPod Touch. Those devices don't support Flash due to Apple's ban of the Adobe Systems' plug-in. In the same vein, Apple earlier this year blocked technology that let developers translate their Flash apps into native iPhone apps, though Apple recently relented on that stance. Here is Skyfire's solution: when you browse a Web page with Flash video, Skyfire's own servers fire up and convert the content into HTML5 on the fly. Clicking on a thumbnail of the HTML5 video then streams it directly from Skyfire's servers to the Apple device. Though designed for the iPhone and iPod Touch, the app will run on the iPad, but only in iPhone-compatibility mode. That doubles the pixels, though, creating a grainy-looking video. Skyfire confirmed that it will release an iPad-specific version of the app at a later date. The app won't convert games or any other nonvideo content. And certain sites, notably Hulu, block Skyfire. That's hardly surprising since Hulu has been trying to drum up interest in its $10-per-month Hulu Plus service, which is available as its own mobile app. Skyfire 2.0 for iPhone follows in the footsteps of Skyfire for Android, which launched earlier this year. Though native Flash support is available in Android 2.2 and higher, people running older versions of Google's mobile OS still need a workaround to view Flash content. Like its Android counterpart, Skyfire for the iPhone runs on top of mobile Safari rather than as a separate browser. But it also includes several unique features of its own. Skyfire's video icon fixes any missing Flash video content that you'd normally see in Safari, which means no more Flash error messages. You can share a video through e-mail and via Facebook or Twitter. The company's servers also adjust the resolution of the streamed video depending on the screen size of the phone and the speed of the network connection. The app will offer relevant videos and other content based on the page you're currently viewing. A desktop mode can display full Web sites, rather than just their mobile versions. And finally, up to eight different browser windows can be opened to display a variety of sites at the same time. &quot;Users don't think about what video technology a site uses. They just want the video to play,&quot; Skyfire CEO Jeff Glueck said in a statement. &quot;With this workaround, Skyfire makes playback possible, while also optimizing the video for mobile screens and networks. <description><![CDATA[I can&amp;'t say I know a whole lot about fashion. But, having accidentally walked into a few boutiques over the years, I&amp;'ve gathered one thing: it&amp;'s expensive. And I&amp;'m told it&amp;'s also a very competitive market a4&quot; designers vie to have their products manufactured by clothiers, who in turn have the question of whether consumers will actuallya4sbuy their productsa4slooming large. These clothing companies do have outlets like Gilt Groupe in case they wind up with excess inventory, but there&amp;'s always significant risk involved whenever a new item is produced.Now Y Combinator-funded startup Fabricly wants to reverse and improve the model, by crowdsourcing designs and using a voting process to only manufacture pieces that people actually want, all while saving customers a bundle.  The company also has some funding news to announce: it&amp;'s recently raised a seed round of $400,000 from Atomico Ventures.Here&amp;'s how it works: first, designers submit their product ideas to the site'a4sdepending on the product, it will either become part of a &amp;8216'competition&amp;' where users vote on which item they like best, or it will go straight to a &amp;8216'pre-order&amp;' stage. Note that it doesn&amp;'t simply go on sale a4&quot;a4sthere&amp;'s a pre-order process that acts a bit like Groupon&amp;'s deals. When you place a pre-order the site will take down your credit card information, but you&amp;'ll only get charged if a certain number of people also pre-order the item, at which point Fabricly has it manufactured. If this threshold is not met, then the order is canceled.Assuming the tipping point is reached, Fabricly then works with factories in Los Angeles and New York to have their items produced (founder Ari Helgason says you can expect to get something you&amp;'ve ordered within a few weeks). Because these goods are being produced on demand, Fabricly doesn&amp;'t have excess inventory to deal with, and Helgason says that users can also expect steep discounts, because it doesn&amp;'t have to maintain any retail outlets either.a4sEach time a designer&amp;'s item is purchased, they receive a 5-15% commission. Last week the first one closed, and $40 million of stock changed hands at $20.76 per share, valuing the company at roughly $50 billion.This week&amp;'s auction has now closed. Only 475,000 shares moved, compared to 1.9 million last week. The auction closing price edged up 1.2% to $21.01, about $10 million worth of stock total.Stay tuned for next week&amp;'s auction. <description><![CDATA[Have you heard the news The Verizon iPhone is coming. Today, Fortune has the 15th or so confirmation that the device will launch in early 2011. There&amp;'s way too much smoke now for there not to be a fire. But even more interesting than that tidbit is Fortune&amp;'s interview with Ivan Seidenberg, the CEO of Verizon. He wouldn&amp;'t speak directly about a Verizon iPhone launch, but he still had plenty to say about the device, and Apple&amp;'s CEO Steve Jobs.The most interesting thing he had to say was the last bit about the iPhone in the piece:According to Seidenberg, Jobs told him during a December 2009 meeting, &amp;''Decisions you made [at Verizon] are decisions we would make at Apple.&amp;''That sounds like it&amp;'s Jobs more or less saying that he respects Verizon because they stood up to him. They wouldn&amp;'ta4scompromisea4son their vision.And that, of course, implies that AT&amp;amp'T was the &amp;''easy&amp;'' company in that scenario. That is, they&amp;'re the ones who were easily romanced into bed. It only took a few drinks. And it sounds as if Apple was fine to have their fling with AT&amp;amp'T while they waited on Verizon, the company they wanted to marry. The company of their dreams. And now the two finally appear ready to tie the knot.The fact that Apple approached Verizon first (this has been reported before), way back in 2005, says it all. The company originally wanted to partner with Verizon instead of AT&amp;amp'T, but neither Verizon nor Apple were willing toa4scompromise. Here&amp;'s the key blurb:Seidenberg&amp;'s soon-to-be-unveiled Verizon iPhone almost didn&amp;'t happen. Verizon executives say they passed on an opportunity to be the exclusive network for the phone back in 2005 largely because they felt that Apple and CEO Steve Jobs wanted too much control over how and where the devices would be sold &amp;8212' and too big a cut of the monthly service fees. Verizon didn&amp;'t want to give up maintenance of its devices or its relationship with its customers, and it sought to distribute the phone through multiple retail partners. So Apple went with AT&amp;amp'T, of course, and conversations between Apple and Verizon about a phone essentially ceased for two years.AT&amp;amp'T was willing to compromise, which Apple undoubtedly appreciated, but perhaps didn&amp;'t respect. Before the launch of the iPhone in 2007, Seidenberg went back to Jobs to break their scorned lover silence. While Apple was already dating AT&amp;amp'T at that point, they agreed to keep flirting on the side.After the iPhone&amp;'s successful launch, problems with AT&amp;amp'T began to arise almost immediately (this has also been reported before). And so in December of 2007, Lowell McAdam (an exec who will be the next Verizon CEO) called the then more vulnerable Jobs to rekindle the flame:He called Jobs in December 2007 and told him, &amp;''We really ought to talk about how we do business together. We weren&amp;'t able to [reach an agreement] a couple of years before, but it&amp;'s probably worth having another discussion to make sure we&amp;'re not missing something.&amp;'' Jobs, according to McAdam, replied, &amp;''Yeah, you&amp;'re probably right. We have missed something.&amp;''But with both sides still wanting their way, anda4sthe AT&amp;amp'T contract in their way, not much tangible happened until this past month when the iPad went for sale in Verizon&amp;'s stores. This was sort of like Price Charles making an official appearance with Camilla Parker Bowles for the first time a4&quot; but only as an &amp;''unofficial companion&amp;''. The wedding is soon to follow.AT&amp;amp'T, meanwhile, is already playing the &amp;''you&amp;'ll never love them as much as you love me&amp;'' card:AT&amp;amp'T wishes its rival good luck with that. &amp;''We carry half the U.S. wireless data on the fastest 3G network,&amp;'' says Larry Solomon, an AT&amp;amp'T spokesman. &amp;''Verizon&amp;'s network hasn&amp;'t been battle-tested yet, so you don&amp;'t know if they can handle the data load or not.&amp;'' In anticipation of competition, AT&amp;amp'T has been signing customers up for new, two-year contracts to discourage defectors to Verizon.Don&amp;'t worry AT&amp;amp'T, you&amp;'ll still get some action on the side. As the star of Best-Picture-nominated The Social Network movie, he plays Mark Zuckerberg in the fictionalized account of the founding of Facebook. He was interrupted by comedian Andy Samberg, who trotted out in a Zuckerberg-style sweat shirt. Samberg said that he felt bad because Eisenberg got nominated for an Academy Award for Best Actor and added, &amp;''What did I get&amp;'' Eisenberg said, &amp;''Well, wasn&amp;'t Facebook just valued at $50 billion&amp;'' Samberg booms, &amp;''All hail the Zuck.&amp;''And then the scene cuts to Zuckerberg himself saying that he wants to go out there because &amp;''those guys are nerds&amp;'' and that he&amp;'s fun because he invented &amp;''poking.&amp;'' The pair talk about how they play Zuckerberg. Then Zuckerberg joins the duo on stage.Samberg said it was &amp;''Awkberg,&amp;'' (suggesting it was awkward that Eisenberg and Zuckerberg had never met before). Eisenberg said he liked Zuckerberg&amp;'s interview on 60 Minutes. Eisenberg asked him if he had seen the movie and Zuckerberg said yes. He said it was &amp;''interesting,&amp;'' and Eisenberg said, &amp;''I&amp;'ll take that.&amp;'' They then introduced the next gig and high-fived each other. It wasn&amp;'t much of a comedy routine. In fact, Zuckerberg has been funnier on 60 Minutes, when he said that the filmmakers got the T-shirts right that Eisenberg&amp;'s character wears. &amp;''I think I own every one of those T-shirts,&amp;'' he said. Zuckerberg was actually far more poised than Eisenberg, who seemed, or at least was acting, like a nervous wreck.Zuckeberg, Sean Parker, and others have laughed off the movie for making their lives far sexier and more dramatic than it really was. But his current attitude toward the film, which has won a lot of accolades, is probably a good one. <description><![CDATA[Socialwise announced today that it has raised $3.4 million in new funding to market its pre-paid credit cards geared towards teen spenders.Socialwise has two main products. The first, called BillMyParents, gives parents a way to let their kids shop on online retail sites. Whenever a teen tries to buy something at site like Amazon.com, the parents are notified and have to approve the purchase. Socialwise then charges the parents an extra 50 cents for each transaction as part of the service.Parents can also load their children&amp;'s allowance money onto a pre-paid card and track their children&amp;'s spending habits. A number of banks already offer this as a service. USAA, for example, has a pre-paid gift card that parents can program to reload with cash on set intervals. BillMyParents, like other pre-paid card vendors, lets parents view each individual transaction. BillMyParents will also send out alerts based on a child&amp;'s spending habits (such as when they are spending too much, too quickly.)Socialwise&amp;'s funding comes at a peculiar time when investors can&amp;'t seem to decide whether they want transactions to go card-less or if they want to revamp how credit cards are used. Mobile transaction services like Boku and Zong, which rely on cell phones and other mobile devices to execute purchases, have raised a good bit of funding. Then you have companies like DEMO graduate Dynamics and their Card 2.0 product, which can carry multiple credit card numbers, also closing some significant funding deals.Funding for BillMyParents is a bet on a card-populated future. Then again, that might not be a bad thing. I know I wish I had been trained to use a credit card over cash when I was younger.
