<description><![CDATA[Former HP CEO Mark Hurd.(Credit:HP)Hewlett-Packard is ready to launch an &quot;independent&quot; investigation into former CEO Mark Hurd's departure from the company.The probe would investigate the circumstances of Hurd's resignation from HP and his separation agreement with the company, according to a January 14 court filing (see below) in U.S. District Court for Northern California. The filing is in response to a shareholder lawsuit that claimed HP wasted as much as $53 million in company funds when Hurd resigned. HP awarded Hurd a compensation package valued at about $35 million at the time of his resignation.HP proposes the probe would be led by a committee of outside attorneys and board members who joined the Silicon Valley giant after Hurd's departure. Hurd, who is now president of HP rival Oracle, resigned as chief executive in August 2010 after sexual harassment allegations led to an inquiry that found he had misreported his expenses to the company.As The Wall Street Journal noted, the only two board members who qualify under that condition are CEO Leo Apotheker, a recent target of scorn from Oracle CEO Larry Ellison, and Chairman Ray Lane, who is a former Oracle president. The scandal surrounding Hurd's departure has also reportedly attracted the attention of the U.S. Securities and Exchange Commission. The SEC is reportedly examining allegations that Hurd passed valuable information about his company's pending acquisition of Electronic Data Systems (EDS) several months before the deal was made public in 2008. The person Hurd is said to have told about the EDS purchase is Jodie Fisher, the former marketing contractor who accused Hurd of sexual harassment.HP officially announced its intent to acquire EDS for $13.9 billion in May 2008. During a previous HP investigation, board of directors felt that Hurd's settlement of a sexual harassment claim impeded its probe into allegations against its former chief executive's behavior. <description><![CDATA[According to Steve Jobs, the real battle betweeniPhone and Android phones didn't start until October.During a rare appearance on Apple's last earnings report, he admitted that Android &quot;outshipped&quot; Apple &quot;as we were transitioning to iPhone 4.&quot; And he added that he was most interested in how sales of the two competing smartphone operating systems did during the final quarter of 2010.How did the iPhone 4 do vs. Android phones during the holiday shopping season (Credit:Apple )We get those results tomorrow afternoon. That's when Apple reports its fiscal first-quarter 2011 earnings, and that means accounting for its October, November, and December sales--prime holiday shopping time. Investors will also be clamoring for information about the health of Jobs, the company's CEO and alter ego. This morning, Apple revealed out of the blue that Jobs, a pancreatic cancer survivor, would be taking a medical leave of absence. No date was given for his return, though Jobs is expected to have a say in strategic decisions, and in his absence, day-to-day operations will be handled by Chief Operating Officer Tim Cook, who also filled in during Jobs' 2009 medical leave. The holiday sales period is crucial for any consumer goods company, but it's particularly important for the iPhone maker to see how it's doing compared to upstart mobile OS distributor Google and its free Android software. It's been proliferating across hundreds of devices and all major carriers, and over the summer began to show rapid gain in momentum. A report from ComScore last week showed Android just inched by iPhone, but remained behind Research In Motion in U.S. sales.Of course tomorrow isn't all about the iPhone. Apple observers are anxious to hear how theiPad did during its first holiday sales period and while it's still one of just a fewtablets for sale--something that will be very different come next December.  Overall, financial analysts are expecting yet another great showing from Apple: on average they expect revenue of $24.38 billion and earnings per share of $5.38. Here's the breakdown, by major product category, of what to look for. iPhone: Bernstein Research thinks Apple will say it sold 15.2 million iPhones in its FYQ1, a 13 percent sequential increase over last year. Some of that increase at the end of the year can be attributed to AT&amp;T allowing its customers to upgrade six months early without penalty starting in June. Many suspected it was a ploy to lock customers into new two-year contracts before the Verizon iPhone was announced last week.Last quarter's earnings call was infused with a little extra drama when Steve Jobs joined the conference call and promptly jumped on the comparisons being made between sales of the iPhone and Android phones. He pointed out that Android &quot;outshipped us while we were transitioning to iPhone 4,&quot; meaning for July, August, and September sales, and that he was looking forward to seeing the results of the last quarter of the year. Tomorrow we'll find out. Obviously the biggest news so far for Apple this year is its introduction--at long last--of an iPhone able to work on Verizon's network. Now that we know Apple makes a CDMA iPhone, the next question is what other carriers that use that technology will be next to get it. KDDI in Japan is an example of a likely candidate.iPad: Though the iPad debuted in early April, the last three months of the year are likely to bear the best results for sales of the touch-screen tablet. Why Because Apple had some well-known problems with its supply of the iPad for Apple stores and other retail partners. Even during its last earnings call in October, Cook admitted that his inventory was still not beefed up to what is typical for Apple. UBS analyst Maynard Um is telling his investors that the most recent quarter for Apple was likely the first that the iPad was not experiencing those supply issues.As a result, UBS adjusted its expectations for iPad sales for the quarter, saying it expects 6 million iPads sold instead of the previous estimate of 5.5 million.The iPad was also available in more places during the holiday season: Apple stores, AT&amp;T stores, plus Target, Wal-Mart, and Best Buy. Verizon also began selling the iPad bundled with a Wi-Fi hot spot in October, all factors which suggest good results tomorrow.Macs:There was only one new Mac released during the quarter, and UBS says it's expecting good results from it. Holiday sales of the MacBook Air, introduced right at the beginning of the holiday shopping season for $999 for the 11-inch model, was likely to attract shoppers, said UBS.Overall, the firm estimates 3.9 million Macs sold during the quarter, which would be 16 percent more than last holiday.iPod: Bernstein estimates Apple sold 19.3 million iPods, down 8 percent from holiday sales last year. That's despite a brand new iPod Touch with FaceTime and a &quot;retina&quot; display, but not much of a surprise: iPod sales have been dropping each quarter for more than a year. Kenneth Ford, one of the attorneys that made news this year by filing copyright lawsuits against tens of thousands of people, told CNET on Monday that he is now working with Dunlap, Grubb &amp; Weaver. DGW is the Washington, D.C., law firm that sometimes operates as U.S. Copyright Group and represents nearly a dozen indie film studios, including the makers of the Academy Award winning war film, &quot;The Hurt Locker.&quot; &quot;[DGW] has initiated new lawsuits today in the U.S. District Court for the District of Columbia on behalf of our clients against nearly 15,000 Doe defendants,&quot; Ford wrote CNET in an e-mail. Among the porn producers DGW and Ford represent are Axel Braun, the maker of &quot;Batman XXX, A Porn Parody.&quot;We now have a legal tag-team grudge match. In one corner is DGW and Ford and in the other are some of the lawyers representing the accused and attorneys from watchdog groups as well as Internet service providers. Among the groups that have opposed the indie and porn studios on their antipiracy campaign are the Electronic Frontier Foundation, the American Civil Liberties Union, and Time Warner Cable. This was bound to happen. Both Ford and DGW in earlier cases ran up against federal courts that didn't appear friendly to the idea of naming thousands of defendants, who live all across the country, in a single district court far from their homes. Thomas Dunlap, co-founder of DGW, told CNET last week that the plan now is to band a group of attorneys who practice in various parts of the country to file complaints in numerous federal districts. <description><![CDATA[Red Dead Redemption, the blockbuster Western video game from Take-Two Interactive, sold more than 8 million units through Dec. 31, thanks in no small part to online content sales.The results show that a big blockbuster console game can get a second life and continuous growth in sales with a strong online expansion strategy. The 8 million games (shipped in) figure is huge for Red Dead Redemption and it&amp;'s a great result for a game that didn&amp;'t have much of a pre-defined following. At $60 a copy, Red Dead Redemption generated an estimated $480 million, which makes it one of the most successful games of the year.Take-Two reported the new number of games shipped with its third fiscal quarter earnings announcement. The company&amp;'s shares rose 4.5 percent in after-hours trading. Take-Two said it hit its earnings targets thanks to some big hits. Revenues for the quarter ended Dec. 31 were $334.3 million, down 7 percent compared with $360.4 million a year ago.GAAP net income from continuing operations was $40.8 million, or 45 cents a share, compared with $39.4 million, or 44 cents a share, a year ago. Non-GAAP net income from continuing operations was $49.5 million, or 52 cents a share, compared with $49.2 million, or 53 cents a share, a year ago. Analysts had expected non-GAAP earnings of 34 cents a share.The biggest contributors to revenues were NBA 2K11, Red Dead Redemption, the disc version of Red Dead Redemption Undead Nightmare, and other old titles. Digital content was a big part of the sales of Red Dead Redemption, Borderlands, and Sid Meier&amp;'s Civilization V.Take-Two has had erratic financial performance for years because it was dependent on Grand Theft Auto sales. When it shipped a GTA game, profits were huge. But when it didn&amp;'t, it usually reported a loss. For the first time, the company has had strong profits in an off-GTA year. That was because the Western gunslinger game, Red Dead Redemption, was such a huge hit. Take-Two measures sales in terms of units shipped into retailers.In the coming year, Take-Two is confident in its ability to deliver more outstanding titles. The company is also going to expand in Asia and Latin America, grow its revenues on new platforms and distribution channels, and launch new downloadable content and online games.Take-Two&amp;'s Rockstar Games division plans to launch L.A. Noire (pictured at top), a cool-looking game with realistically animated human faces, on May 17 in North America. Take-Two&amp;'s 2K Games label also plans to launch Duke Nukem Forever on May 6. That title has been in the works for more than a decade. Take-Two said that NBA 2K11 sold more than 4 million units.For its fourth fiscal quarter ending March 31, Take-Two estimates revenue will be $130 &amp;8211' $150 million, with a loss per share of 40 &amp;8211' 45 cents. For the fiscal year ending March 31, the company expects revenue to be $1.08 &amp;8211' $1.10 billion.
